DISTANCE SALES AGREEMENT

ARTICLE 1 – PARTIES

This Distance Sales Agreement ("Agreement") is entered into between Solera Felice ("SELLER"), operating through the website www.solerafelice.com (the "Platform"), and the "BUYER" who registers on or makes a purchase through the Platform.

  • Buyer: The individual who places an order through solerafelice.com. The Buyer's name, surname, address and contact details are entered during the order process.

ARTICLE 2 – SUBJECT OF THE AGREEMENT

The subject of this Agreement is to determine the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the product(s) ordered by the BUYER electronically through solerafelice.com.

ARTICLE 3 – PRODUCT INFORMATION AND PRICE

  • Product Name: Beachwear and accessories sold under the Solera Felice brand.
  • Product Characteristics: Handcrafted beachwear items including kimonos, dresses, sets, tops, and shell accessories, produced in limited quantities.
  • Price: The price applicable at the time of order as displayed on solerafelice.com. The SELLER reserves the right to apply discounts and price changes. Current prices are always displayed on the website.
  • Payment Method: Payment is collected in full at the time of order by credit card, debit card, or other available methods. All transactions are processed securely via iyzico with SSL encryption.

ARTICLE 4 – DELIVERY AND PERFORMANCE

Orders are prepared and shipped within 1–3 business days following payment confirmation. Estimated delivery time is 2–5 business days depending on the carrier and region. A tracking number will be sent to the BUYER's registered email address upon dispatch. The product is delivered to the address specified in the order form.

ARTICLE 5 – RIGHT OF WITHDRAWAL

5.1. Exercise of Right of Withdrawal:

  • The BUYER has the right to withdraw from the agreement within 14 days without stating any reason and without incurring any penalty.
  • The withdrawal period begins on the day the product is received by the BUYER.

5.2. Notification of Withdrawal:

  • The BUYER must notify the SELLER in writing of the intention to withdraw before the expiry of the withdrawal period.
  • Withdrawal notice may be sent to info@solerafelice.com.

5.3. Consequences of Withdrawal:

  • Upon valid exercise of the right of withdrawal, all amounts paid by the BUYER will be refunded within 14 days.
  • The refund will be made using the same payment method used by the BUYER, with no additional charge.
  • The product must be returned unused, unwashed, with all original tags intact, in its original packaging, and with the hygiene seal unbroken (where applicable).

5.4. Exceptions to the Right of Withdrawal:

Pursuant to Article 15 of Law No. 6502, the right of withdrawal cannot be exercised in the following cases:

  • Products prepared specifically in accordance with the BUYER's personal requests or needs.
  • Products whose protective packaging (seal, band, hygiene strip) has been opened after delivery, and whose return is not appropriate for health or hygiene reasons.
  • Products that have been used, washed, or damaged after delivery.

ARTICLE 6 – GENERAL PROVISIONS

6.1. Privacy:

  • The BUYER's personal information shall be kept confidential by the SELLER and shall not be shared with third parties. For further details, please refer to our Privacy Policy.

6.2. Dispute Resolution:

  • In the event of disputes arising from this Agreement, Consumer Arbitration Committees and Consumer Courts shall have jurisdiction. Turkish law applies.

6.3. Entry into Force:

  • By approving the order electronically, the BUYER is deemed to have accepted all terms and conditions of this Agreement.

ARTICLE 7 – ADDITIONAL PROVISIONS

7.1. Amendments:

  • The SELLER reserves the right to amend the provisions of this Agreement. Any changes will be communicated to the BUYER and will take effect upon the BUYER's approval.

7.2. Force Majeure:

  • Situations beyond the control of the parties that prevent the fulfillment of obligations under this Agreement shall be considered force majeure. In such cases, neither party may claim compensation from the other.
